Simple question or biased simplified question?

At the heart of this lively debate, the hearing was launched on the Internet in mid-November and described as a “referendum” by Valérie Pécresse. In the wording of the question, the town hall seems to be right: there has never been a question of removing a lane from the ring road as part of Olympics, but of a transformation. The planned project, which was adopted by the Paris City Council despite a measure generating “very majority rejection” in a survey conducted by the city in February, will be carried out in two phases:

  • for JO 2024 : a Olympic way will be reserved for “athletes, media, officials, rescue and law enforcement”, with the exception of the section between Portes de Versailles and Bercy. This route will be funded by Solideo, the company responsible for the Olympic Games.
  • after Paris 2024 : maintenance of this route “to allow the creation of a lane reserved for carpooling and other virtuous modes of transport”, the list of which is not definitive.

A dual goal without removing a channel that the region is fully informed about because it mentions it in the “I inform myself” section of the site for its consultation. The nuance lies in the fact that the new route for the region will not be “for everyone”, as it will be reserved for certain forms of mobility. An unspecified nuance on the voting side.

An “illegal” or democratically valid consultation?

In addition to this clearly visible bias – and certainly voluntary – the region is under attack on the legality of its process. “This hearing, which spreads false news, acts as a quiz,” said Emmanuel Grégoire, recalling that the ring road, which is entirely on the territory of the city of Paris, is also within its remit.

This “referendum” was a promise from the candidate Pécresse to the region, and Emmanuel Grégoire sees “a message about the candidate” for the LR primary for the presidential election, made “on a day of high pollution”. He “hopes that the illegality of the hearing” will be recognized by the courts, especially because the regional council has not validated it by a vote.

Reasoned for “the importance of the ring road for a very large number of residents of Ile-de-France”, because “used every day by 1.2 million vehicles”, this vote in the region “is open to all persons with an account France Connect ”.

Justice will determine which of the two camps is right. The only certainty is that the consultation launched by the region does not meet any of the legal criteria for engaging a local decision making (RDL), possibility provided by law under the following conditions:

  • a “voting day” must be set after a vote in the local “advisory assembly”;
  • it can not take place “less than two months after the text has been sent to the prefect”;
  • “Only the voters” can participate “and not all the inhabitants”.

And above all, as stipulated in the first article of the law on the general provisions of the RDL, the referendum must be limited “to deciding a matter within the competence of the Community” that organizes the vote. A point that tends to confirm the lack of democratic value of the question posed to the residents of Ile-de-France by the president of their region, who has still not been able to regain jurisdiction over the refusal, as she claimed in the spring.
